Art. 5.° El artículo 130 del Código Penal quedará así:

"Art. 130. El que habiendo sido condenado por sentencia ejecutoriada por algún delito o culpa, cometiere otro delito o culpa diferente del primero, será castigado por la primera reincidencia con la pena que merezca el nuevo delito, aumentada en una tercera parte más; y por las demás reincidencias sufrirá el doble de la pena."
