En desarrollo del artículo único del Acto Legislativo número uno (1), de veintiocho (28) de diciembre de mil novecientos sesenta y tres (1963), créase el Departamento de la Guajira, formado por el territorio de la Intendencia del mismo nombre e integrado por los Municipios de Ríohacha, Uribia, Maicao, Barrancas, Fonseca, San Juan del Cesar y Villanueva. Su capital será la ciudad de Ríohacha.

Parágrafo

Los límites del Departamento de la Guajira en ningún caso afectarán la integridad territorial del Departamento del Magdalena y serán determinados por el Instituto Geográfico Agustín Codazzi. El Gobierno Nacional queda autorizado para dictar las medidas pertinentes destinadas a adoptar la anterior delimitación.
