Adiciónase el artículo 146 del Estatuto Orgánico del Sistema Financiero con el siguiente numeral:

"9. Conflictos de interés. Los directores, representantes legales, revisores fiscales y en general todo funcionario de entidades fiduciarias con acceso a información privilegiada deberá abstenerse de realizar cualquier operación que de lugar a conflictos de interés entre el fiduciario y el fideicomitente o los beneficiarios designados por este. La Superintendencia Bancaria determinará y calificará en la forma prevista en los incisos 2º y 3º del numeral 6 del artículo 98 del presente Estatuto, la existencia de tales conflictos. Así mismo, podrá establecer mecanismos a través de los cuales se subsane la situación de conflicto de interés, si a ello hubiere lugar."
