Toda persona que en el país explote o refine petróleo procedente de concesiones nacionales o de yacimientos reconocidos como de propiedad particular, tiene derecho a construír y beneficiar uno o más oleoductos para el servicio de su propia explotación o explotaciones o el de sus afiliadas. Toda persona, natural o jurídica, con capacidad financiera suficiente, puede construír oleoductos de uso público, previo contrato con el Gobierno y de acuerdo con las disposiciones vigentes. El Gobierno también podrá construír oleoductos de uso público, directamente o por contrato.
