º Nombramientos ilegales. Todo nombramiento que no cumpla con las estipulaciones firmadas en los artículos 5º y 6º de este Decreto es ilegal y podrá ser declarado por la jurisdicción contencioso administrativa. Así mismo, la autorización nominadora que lo haya proferido deberá declarar la inconsistencia subsiguiente tan pronto como tenga conocimiento de la ilegalidad, so pena de incurrir en causal de mala conducta.
