En el caso del artículo 1937 del Código Civil, el vendedor puede pedir al Juez que declare haber ocurrido el evento allí previsto.

De esta petición se da traslado al demandado, y si éste no se opone o no hace el pago dentro de las veinticuatro horas siguientes a la notificación, el Juez declara que está resuelto el contrato, y ordena la cancelación de la inscripción del título si se trata de inmuebles.
