Diligencia de sorteo. El señalamiento para la diligencia se hará para el día siguiente a la desfijación del aviso. Esta diligencia se practicará en presencia de los miembros del tribunal y del secretario, y al acto asistirán las partes, el ministerio público y los demás interesados. La falta de asistencia de alguna o algunas de las personas que tienen derecho a hacerlo no la invalidará, con tal que se verifique con asistencia de la mayoría de los miembros del tribunal o, en su lugar, por ante el secretario y dos testigos.
