LEGISLACIÓN ANTERIOR

Artículo 86. PROHIBICION PAGO DOBLE SUBSIDIO FAMILIAR. En ningún caso habrá lugar al reconocimiento de doble subsidio familiar. Cuando el cónyuge del Oficial o Suboficial preste sus servicios en el Ministerio de Defensa o en la Policía Nacional, el subsidio familiar se reconocerá al cónyuge que perciba mayor asignación básica; si ésta fuere igual, recibirá el subsidio quien acredite mayor tiempo de servicio.

Parágrafo

El Oficial o Suboficial de la Policía Nacional cuyo cónyuge preste servicio en otra entidad oficial, para obtener derecho al subsidio familiar, deberá acreditar que su cónyuge ha renunciado a dicha prestación en la entidad en donde trabaja, mediante certificación expedida por esta última.
