La autoridad marítima queda facultada igualmente para determinar mediante resolución motivada, en qué casos, por el porte del buque, la clase de carga transportada u otra razón especial, el Primer Oficial y/o el Primer Maquinista deben estar en posesión de licencia de navegación de Capitán y/o de Maquinista Jefe, según corresponda.
