Sanciones al recusante . Cuando una recusación se declare no probada y se disponga que hubo temeridad o mala fe en su proposición, en el mismo auto se condenará al recusante y al apoderado de este, solidariamente, a pagar una multa de cinco a diez salarios mínimos mensuales, sin perjuicio de la investigación disciplinaria a que haya lugar.
