Cuando la ley exija expresamente para la validez de determinado acto que se llenen ciertas formalidades y éstas no se observaren, se considerará que tal acto no se ha verificado.

No es necesaria providencia especial para declarar la inexistencia del acto en los casos a que se refiere este artículo.
