El Gobierno decretará el pase de un Oficial a la reserva a solicitud del mismo Oficial o a petición del Comandante superior respectivo, según la calificación personal de aquél. No se concederá dicho pase ni la separación del Ejército, cuando exista compromiso para servir en el mismo Ejército durante determinado número de años, salvo los casos de mala conducta comprobada y previo pago de la indemnización, conforme el contrato entre el Gobierno y el Oficial.
