Art. 73. Se entiende que un gasto no es legítimo:

1° Cuando se haya reconocido y librado la orden de pago por servicios no prestados, ó por derechos no adquiridos;

2° Cuando no haya crédito apropiado al efecto; y

3° Cuando el crédito apropiado se haya agotado, á pesar de que exista aún sin invertir alguna cantidad insuficiente del respectivo crédito;
