Art. 44. Cuando los responsables no suministren las estampillas ó el papel sellado correspondiente para la actuación, ésta se continuará en papel común; y el Contador que hubiere dictado el auto de primera instancia, declarará al interesado incurso en la multa de cinco pesos por cada estampilla que falte ó por cada hoja de papel sellado que deje de suministrar, y elevará á cargo líquido el alcance que le haya deducido en el auto. Si el incidente ocurriere en la segunda instancia, se devolverá el expediente al Contador que conoció en la primera, para los efectos de este artículo.
