Dentro de los cinco días siguientes al vencimiento del término probatorio, el juez atendiendo las pruebas que obren en el juicio, fijará la fecha de la cesación de los pagos, la cual no podrá ser anterior en más de un año al día de la presentación de la demanda o de la denuncia del estado de quiebra o de la fecha de la presentación de la solicitud de concordato preventivo, según el caso.
