ARTICULO 40 . Prejudicialidad . La competencia del funcionario se extiende a las cuestiones extrapenales que surjan en la actuación penal; pero si son a la vez elementos constitutivos del hecho que se investiga y sobre ellas estuviere pendiente decisión judicial al tiempo de cometerse, no se proferirá auto calificatorio mientras dicha decisión no se haya producido. No obstante, si transcurrido un año desde la oportunidad para proferir calificación no se hubieren decidido definitivamente las cuestiones que determinaron la suspensión, se reanudará la actuación.
