ARTICULO 44. Auto inhibitorio. El jefe de la unidad investigadora, previo estudio de la queja, de la información o del resultado de las diligencias preliminares, podrá abstenerse de ordenar el adelantamiento de la investigación disciplinaria, caso en el cual, archivará la queja. El auto inhibitorio no hará tránsito a cosa juzgada, pudiendo adelantarse proceso disciplinario cuando se encuentren nuevos hechos o pruebas que constituyan mérito suficiente para ello.
