La tercera parte de la cuantía mínima del margen de solvencia, fijada en la forma prevista en el artículo anterior, constituye el fondo de garantía, que no podrá ser inferior a los patrimonios técnicos mínimos a que alude el artículo 39 de la presente Ley.
