Las sanciones de suspensión o destitución serán decretadas, a solicitud de la Procuraduría General de la Nación, por el Presidente de la República si se trata de los gobernadores o alcaldes del distrito, y por los gobernadores cuando se trate de alcaldes municipales de su respectivo departamento.
