Si la sustracción de que trata el artículo anterior se lleva a cabo en víveres, medicinas, semovientes, equipo, vestuario u otros elementos destinados al servicio de las Fuerzas Militares, se incurre al presidio de uno a cuatro años.

La pena es dos a ocho años si de la sustracción resultan perjuicios para la salud de las tropas.

Si la cuantía de lo sustraído sube de seis mil pesos, la pena es de cuatro a quince años.
