Un tenedor en debida forma es aquel que ha recibido el instrumento bajo las siguientes condiciones:

1° De que es completo y regular en su forma exterior;

2° De que lo adquirió antes de haber pasado la fecha del vencimiento y sin noticia de que hubiera sido previamente rechazado, si fuere el caso;

3° De que lo tomó de buena fe y por un valor, y

4° De que a tiempo de negociarlo no tuvo noticia de ningún vicio en el instrumento o en el título de la persona que lo negoció.
