Garantías Admisibles

° Garantías admisibles. Para los propósitos del artículo anterior, se considerarán garantías o seguridades admisibles para garantizar obligaciones que en conjunto excedan del diez por ciento (10%) del patrimonio técnico aquellas garantías o seguridades que cumplan las siguientes condiciones

Que la garantía o seguridad constituida tenga un valor, establecido con base en criterios técnicos y objetivos, que sea suficiente para cubrir el monto de la obligación; y

Que la garantía o seguridad ofrezca un respaldo jurídicamente eficaz al pago de la obligación garantizada al otorgar al acreedor una preferencia o mejor derecho para obtener el pago de la obligación.
