Son funcionarios de instrucción respecto de los delitos de que tratan la Ley 51 de 1898 y la presente, los Jueces Superiores y los del Circuito; pero el juzgamiento de dichos delitos en primera instancia corresponde á los primeros, sin intervención el Jurado, con excepción de los hechos señalados en el inciso 3º del artículo 42 de la expresada Ley 51, de los cuales conocerán los funcionarios allí nombrados.
