La incapacidad del trabajador será fijada por el médico del patrono, pero su dictamen podrá ser revisado y modificado con carácter de obligatoriedad por la División de Medicina Industrial. Y donde ésta no exista, por el Médico Oficial o Legista más próximo. En caso de error manifiesto en un dictamen se comunicará el hecho al Colegio Médico de la respectiva Sección del país.
