Cuando en el sumario no apareciere la comprobación requerida por el artículo 429 para dictar auto de proceder, se entregará el menor a su familia o a las personas de quienes dependa, si estuviere moralmente abandonado; si no estuviere moralmente abandonado, se ordenará su internamiento en un instituto adecuado para menores no delincuentes.
