Art. 97. Cuando faltaren el principal y los suplentes, el Tribunal nombrará un suplente interino, que funcionará mientras pueda hacerlo uno de aquéllos.

De la propia manera se procederá cuando el principal y los suplentes estén impedidos ó sean recusados para conocer en un asunto determinado, sin perjuicio de lo dispuesto en el segundo inciso del artículo 95.
