º. Le corresponde a la Comisión Nacional de Valores certificar la calidad de sociedad anónima abierta. Con respecto al año gravable de 1983, las sociedades anónimas que al 30 de septiembre de dicho año reúnan las calidades para ser consideradas abiertas, deberán elevar la solicitud correspondiente antes del 15 de noviembre de 1983, ante la mencionada entidad, la cual deberá expedir dicha certificación a más tardar el 31 de diciembre del mismo año. Las solicitudes relativas a la certificación a que hace referencia este articulo para los años gravables de 1984 y siguientes, deberán presentarse antes del 15 de febrero del respectivo año, siempre y cuando haya permanecido abierta al menos durante el segundo semestre del año inmediatamente anterior. La Comisión Nacional de Valores certificará lo pertinente a más tardar el 1º de abril del año respectivo.
