Cuando la inspección ha de practicarse fuera del territorio de la jurisdicción del Juez, éste comisiona al del lugar respectivo; y de igual modo se procede cuando el Juez de la causa cree conveniente comisionar a uno inferior aunque la diligencia se realice dentro del mismo territorio, salvo que alguna de las partes exija que, a su costa, se haga la diligencia por el mismo juzgador.
