Si cualquiera de las conductas de que trata el artículo 102 de este Código fueren realizadas por los comandantes de base, patrullas, contraguerrillas, tropas de asalto, fuerzas especiales y demás unidades militares o de policía, comprometidas en operaciones relacionadas con el mantenimiento del orden público, guerra o conflicto armado, la pena será de uno (1) a tres (3) años de prisión.
