Provisión de cargos. Cuando se produzca una vacante en un cargo docente o directivo docente, el nominador deberá proveerla mediante acto administrativo con quien ocupe el primer lugar en el respectivo listado de elegibles del concurso. Sólo en caso de no aceptación voluntaria de quien ocupe el primer lugar, se podrá nombrar a los siguientes en estricto orden de puntaje y quien rehúse el nombramiento será excluido del correspondiente listado.

Parágrafo

Los listados de elegibles tendrán una vigencia de dos (2) años, contados a partir de su publicación.
