ARTICULO 28 . ORDEN QUE ENTRAÑA HECHO PUNIBLE. Si la orden conduce manifiestamente a la comisión de un hecho punible, el subalterno no está obligado a obedecerla; en caso de hacerlo, la responsabilidad recaerá sobre el superior que emite la orden y el subalterno que la cumple o ejecuta.
