La acción disciplinaria es procedente aunque el militar se haya retirado del servicio activo.

Cuando la sanción no pudiere cumplirse porque el infractor esté retirado del servicio, se anotará en su hoja de vida y se compulsarán copias a los funcionarios de ejecuciones fiscales correspondientes.
