° Si alguna de las personas que hubiere intervenido en la comisión de los hechos punibles confesados no se encontrare en las condiciones señaladas en el artículo primero de este Decreto, el juez que esté conociendo de los hechos investigará por separado estos comportamientos, rompiéndose la unidad procesal.
