Salvo previa orden del funcionario instructor, los miembros de la Policía Nacional no podrán actuar en la institución preliminar cuando se trate de delitos en que aparezcan como presuntos sindicados individuos de la institución. En consecuencia, el funcionario de la instrucción a quien corresponda deberá avocar desde su comienzo la instrucción preliminar.
