Si la obligación fuera de entregar un cuerpo cierto y de pagar perjuicios no determinados en cantidad líquida por estipulación, esto se estimará por el demandante en la demanda con protesta de estimación equitativa, en cantidad mensual en dinero desde que empezó la mora hasta el tiempo de la entrega de la especie, o pago de su precio, y para la entrega de aquélla y pago de éstos puede librarse la ejecución.
