Art. 416. El funcionario de instrucción requerirá al Jefe Militar para que ponga a su disposición al sindicado, cuando fuere necesario recibirle declaración indagatoria hacérsela ampliar, someterlo a careo o practicar otra diligencia de investigación que necesite su presencia; pero terminado el acto, el sindicado será devuelto à la prisión militar.
