° La fianza con que los Habilitados aseguren los fondos de su manejo, puede ser personal, hipotecaria ó prendaría. En el caso de ser personal, los fiadores serán individuos de reconocida solvencia á juicio del funcionario encargado de aceptarla. Si fuese prendaría será previamente valuada la prenda por el encargado de aceptar la fianza y por uno de los vecinos más respetables del respectivo lugar. Cuando se asegure con fincas raíces, deberá comprobarse la propiedad de éstas, ó la facultad que se tenga para hipotecarlas, la libertad de ellas y su valor libre, debiendo igualar éste, lo mismo que el de la prenda al de la fianza exigida y la mitad más.
