El funcionario de instrucción deberá practicar todas las investigaciones necesarias para apreciar el carácter y la conducta anterior del procesado, conocer sus antecedentes personales y de familia, el ambiente en que ha vivido, las relaciones que ha mantenido o cultivado, y, en general, todo lo que pueda descubrir su personalidad y los motivos que lo han inducido al delito.
