La Escuela Militar es un instituto especial del Ejército, compuesto de Cadetes, Subrigadieres, Brigadieres y Alféreces, más los Oficiales de Planta que determinen al Reglamento orgánico del instituto. Tendrá el cuerpo directivo y docente necesario, Contador, Oficial de Sanidad, Capellán, Ecónomo y el personal de servicio que el Gobierno determine.
