ART 255. Cuando en un juicio de ejecución se admitan tercerías excluyentes ó coadyuvantes, el ejecutante recobra el derecho que al practicarse las diligencias ejecutivas tiene según el artículo 940 del Código Judicial (1026, edición de 1887), y los anteriores al presente, para denunciar más bienes de la pertenencia del ejecutado, á menos que se constituya nueva fianza de saneamiento.
