El Fondo de Promoción de Exportaciones será una persona jurídica autónoma sometida a la vigilancia del Superintendente Bancario y funcionará anexo al Banco de la República mediante contrato entre éste y el Gobierno Nacional. Queda autorizado el Banco de la República para celebrar el contrato a que se refiere el inciso anterior, el cual sólo requerirá para su validez la aprobación del Presidente de la República, previo dictamen favorable del Consejo de Ministros.
