Los rebeldes no quedarán sujetos a responsabilidad por las muertes o lesiones causadas en el acto de un combate; pero el homicidio cometido fuera de la refriega, el incendio, el saqueo, el envenenamiento de fuentes o depósitos de agua, y en general los actos de ferocidad o barbarie, darán lugar a las sanciones respectivas, aplicadas acumulativamente con las de rebelión.
