El artículo 197 del Código Penal, quedará así:

Artículo 197 . Tenencia, fabricación y tráfico de sustancias u objetos peligrosos. El que ilícitamente importe, introduzca, exporte, fabrique, adquiera, tenga en su poder, suministre, transporte o elimine substancia, objeto, desecho o residuo peligroso o nuclear considerado como tal por tratados internacionales ratificados por Colombia o disposiciones vigentes, incurrirá en prisión de tres a ocho y multa de cincuenta a trescientos salarios mínimos legales mensuales vigentes.

La pena prevista en este artículo se aumentará hasta la mitad si las conductas anteriores se realizan sobre armas químicas, biológicas o nucleares.
