No tendrán derecho á recibir asignación los herederos del militar que fue dado de baja por mala conducta ó deslealtad al Gobierno, ó que fue condenado por Tribunal competente á la pérdida de su grado y no se rehabilitó, y finalmente si fue condenado á pena corporal infamante y falleció durante la pena. Son extensivas estas inhabilidades á las personas de los deudos llamados á heredar al militar contribuyente.
