El Poder Ejecutivo nombra todos los empleados del Ministerio Público, con excepción de los Personeros Municipales, cuya designación corresponde a los Concejos ; pero puede delegar esta atribución las Asambleas Departamentales, o a los Gobernadores, en lo que respecta a los Fiscales, sobre las ternas presentadas por las Asambleas Departamentales.
