Si el demandado o quien lo representa se halla fuera del país, la comisión se confiere al Cónsul colombiano que corresponda, y en su defecto al de una nación amiga para que haga la notificación del traslado.

El despacho se envía por conducto del Ministerio de Relaciones Exteriores, y si la comisión se confiere a un Cónsul extranjero, se hace en forma de carta rogatoria, sin perjuicio de lo que se disponga en los tratados públicos.
