El que obtenga el acceso carnal a una mujer mayor de catorce años, empleando al efecto maniobras engañosas o supercherías de cualquier genero, o seduciéndola mediante promesa formal de matrimonio, está sujeto a la pena de uno a seis años de prisión.

A la misma pena está sujeto el que tenga acceso carnal con una persona que padezca de alienación mental o que se halle en estado de inconsciencia.
