Si agotada la fase probatoria, el funcionario de conocimiento advierte la necesidad de variar los cargos, por error en la calificación o prueba sobreviniente, así lo declarará motivadamente. La variación se notificará en estrados y se otorgará un término de cinco días hábiles para presentar descargos, solicitar y aportar otras pruebas.
