Al miembro de una Balsa que no constituya oportunamente las garantías especiales que debe otorgar a las adicionales que le fueren exigidas por la Superintendencia Bancaria por la Bolsa, según el artículo 35 se le aplicarán inmediatamente las sanciones previstas en el artículo 33. Además el Gerente de la Bolsa, a elección del miembro contratante que haya otorgado la garantía a su cargo, declarará resuelta Ia operación o bien la hará liquidar mediante el procedimiento autorizado en el artículo anterior. En uno a otro caso habrá lugar a la indemnización de los perjuicios resultantes, que se hará efectiva ante el Juez competente.
