Presentada la demanda, el Juez ordena el secuestro de los bienes y nombra el secuestre.

Si al tiempo del secuestro los bienes se hallan en poder de persona que alegue algún derecho sobre ellos, se le dejan y se le previene que comparezca al juicio. Lo mismo se hace si están en secuestro.
